Democrats in the state Senate are not moving forward with a bill that would’ve proposed writing same sex marriage into law, nj.com reports.

State Senate Majority Leader Loretta Weinberg told nj.com the bill was being pulled from consideration on the legal advice of the gay rights law group Lambda Legal. Senate Judiciary Committee was to consider the bill on Monday.

Some legislators proposed the bill because they felt the legality of the justification for same-sex marriage could be rendered ineffective if the federal government grants couples in civil unions the same benefits possessed by those in traditional marriages, according to the report. The bill would’ve secured the legality of the legislation.

However, Lambda Legal advised that writing the bill into law would raise religious questions not addressed by the initial court decision to legalize same sex marriage, leading to the decision to withdraw the bill, according to the report.
