Former Cop, Beach Tag Boss Arrested for Sexual Contact With a Minor
Chuck Cusack is charged with second degree sexual contact.
A retired Ocean City police officer who is in his second season as a superintendent of the city's beach tag operations was arrested Saturday and charged with second-degree sexual contact with a beach tag inspector.
Charles Cusack, 49, was arrested by city police about 4:30 p.m. Saturday while on duty, Capt. Steven Ang said. Cusack was transported to the Ocean City Police Department, his place of employment until his 2011 retirement.
Cusack, who resides in Egg Harbor Township, was charged with second-degree criminal sexual contact with a female under the age of 18 who was under his supervision, Ang said. He was released after he posted $150,000 bond.
Ang said Cusack has been suspended from his city post pending outcome of the investigation.
Ang said the alleged sexual contact occurred over a period of time, but he declined to be more specific.
"It's an embarrassment to the city and to the Ocean City Police Department, but we're more concerned about protecting the victim and the victim's family," Ang said.
A condition of Cusack's release was that he have no contact with anyone in the beach tag program, Ang said.
As part of his duties during 25 years in the OCPD, Cusack worked as a bicycle officer for about a year in the community policing division, which has close interaction with Ocean City High School, Ang said. Cusack also worked at the high school as a school resource officer in the two years before he retired from the police department, said Michael Stanton, Ocean City schools solicitor.
The schools then hired Cusack in fall 2011 to replace a retiring "supervisory aide" in the high school, Stanton said. In the hourly security position, Cusack "acted as a presence" in hallways and throughout the school. He was employed under contract from Jan. 3 through June 30. His contract was not renewed because the position was eliminated, Stanton said.
Cusack has three daughters and had been separated from his wife at the time of his arrest.
Second-degree sexual contact encompasses sexual contact with a victim at least 13 but less than 16 years old (with a suspect at least four years older than the victim) or with a victim at least 16 but less than 18 years old and the suspect has supervisory or disciplinary power over the victim. Sexual contact means, at minimum, the intentional touching of intimate parts for sexual gratification.
Second-degree offenses are subject to sentences of five to 10 years in state prison.
A news release from Cape May County Prosecutor Robert Taylor indicated that the alleged victim is between the ages of 16 and 18 but included little other detail.
The case will be investigated by the prosecutor's Major Crimes Unit because of Cusack's employment with Ocean City, Taylor said.
A call to Cusack's cell phone is answered by a message that says the number has been changed or is out of service.
The beach fee staff was advised of the situation at group meetings on Sunday morning.
“I don’t have the words to express my outrage over this matter," Mayor Jay Gillian said. "My primary concern is the safety and well-being of our team members. I have directed my staff to make certain that these young people know they have our support in every regard in the days ahead.”
The city has arranged for counseling to be made available to any member of the beach fee staff who requests it.
David Elliott will manage the beach tag program for the remainder of the season, according to Ocean City Business Administrator Mike Dattilo. Elliott has worked at all levels of the program beginning as a beach tag inspector eight summers ago. He is an Ocean City resident.
Update: As of Wednesday, Aug. 8, the Cape May County Superior Court Criminal Division said no attorney has entered an appearance on behalf of Cusack, and no arraignment is scheduled. The case is still in the complaint stage.

It must become policy that no one adult be left alone with any child not their own.....nor should any adult want to be alone with a group of children without another adult present...... sports, scouts, church youth groups and after school programs must have two adults present at all times. An arrest and charge doesn't mean a conviction. I don't know this guy but I do know that many people get accused for sexual offenses and it is the responsiblity of the authorities to investigate as thoroughly as possible, especially when minors are involved. You would be surprised to know what kind of information can be considered enough for an arrest/charge.

Um, Tara, the Aide actually did retire. He went out on medical leave. Don't make statements that you know nothing about. As to those condemning the man based on an accusation, an accusation is not necessarily a guilty sentence, that's why one is innocent until proven guilty. For those who say he shouldn't be working for the city...what are retired public servants supposed to do, curl up and die? I agree that an accusation is just that - an accusation. An arrest does not mean that someone is guilty of anything. All of that will be sorted out in the course of a continuing investigation and trial.
What bothers me a lot more at this point - since it is all we know vs what has been alleged - is the double dipping. Here we have a public worker who is paid by the taxpayer who retires in his 40s and begins to collect a pension and then is given a 'retirement job' so that he may have the benefits that come with working in the public sector while collecting his pension. Does the supervisory job also have a pension tied into it? And since this retired person does not live in OC wasn't it possible to find anyone in our city who qualified for this supervisor job?

I am a former student in Ocean City Highschool while Mr. Cusack worked within the school. From my experience being around him and talking with him, he was nothing less than professional. When I heard this news, I was completely in schock. I just can not believe that the same man I had got to know over my years at OCHS would do something like this. To say that "Mr. Cusack was a little strange" is not right. He did not, to my knowledge or anyone else I knew from Ocean City, ever do anything to warrant that sort of accusation. I looked up to, and trusted this man. Mr. Cusack never failed to help me work through any sort of problem I had, whether it was school related or trouble with friends, family-whatever it was, he was there for me. I can only try to do the same him and his family(who I do not know personally) .Time will tell whether or not the crime was comitted but until then it is not right to acuse him of doing something that could very well all be false.

I'm aware that people can successfully hide dark, nefarious tendencies from close friends, co-workers, and family; however, I have been with Mr. Cusack when he was working with young people and thought he was perfect for the job. I got to know Chuck years ago when he was a member of my fitness club in OC. When I read his name today I was incredulous. My impression of him was that he could not be capable of such a thing. Although I'm not foolish enough to think that even nice, kind, soft spoken people cannot commit these sorts of acts, I also know that people ARE innocent until proven guilty. I hope he is innocent.

A friend was once accused of something similar by a middle school student where he taught. With no investigation.....only based on an allegation......my friend was arrested. He made the news on 3 Philadelphia tv news networks and on TV40. He was on the front page of all the Philly newspapers and most of the South Jersey papers. The Ocean City news paper sunk so low as to publish the story listing him as the owner of a local business where he is a partner. They did it in such a manner to hurt the business. When the dust settled and the allegation was investigated it was found that the "child" was clearly not telling the truth and had also pulled the same stunt at her previous school more than once. Nice huh???!!!! No retractions from those TV stations or any of those newspapers.
The media is quick to destroy someone but never comes back to clear someone's name since its not a flashy news story anymore.
I haven't bought a copy of that OC newspaper since.

Good point, Duffer. I am familiar with a similar story in Chicago or Boston several years ago involving a very famous prelate. The accuser later recanted following months of the newspapers splashing the story over and over again. When the supposed victim recanted, the story suddenly disappeared.

I find it disgusting that any middle aged man would want a relationship with someone (even) 22 years old. What could you possibly have in common with someone so immature? The 17 year olds of today are nothing like they were when I grew up, and they weren't so good when I grew up either. I have witness young women/ girls peruse older men be ause they thing the older guy offer financial security. The girls of today don't want to wait and build their financial future with someone their own age, they want to have it now by getting a financially secure older man. I currently have two long time friends that are now single again, who date young girls in their early to mid twenties. I tell you, they have no shortage of finding these girls either. Richard - the man held a staff position at OCHS and had access to teen females in OCHS that he then hired to work for him as subordinates. He knows their ages, he knows the laws, he broke the law. I do not know Officer Cusack personally, but as a student at OCHS I saw him around. He seemed like a nice guy, and pretty good at his job, but I realize that some have hidden morals/lives. I'm not really interested in debating whether the supervisor-teenager law is warranted, but rather if Mr. Cusack broke it. Personally, I do not condone, in fact am disgusted by, men who would have sexual contact with a girl that age, especially if married with kids. Although I'm sure the police department had sufficient evidence for the arrest, I believe in the pillar of the American legal system that an accused person is innocent until proven guilty. I don't know how anyone can condemn a man without ANY confirmed factual evidence, let alone a fair trial. I agree that what he is accused of is revolting, especially considering his work history, but I would have patience in condemning him. I wouldn't let disdain for the alleged "double-dipping" somehow contribute to his guilt. And I also wouldn't accuse those who perhaps have an opposing view of yourself of perversion themselves. Let's not cloud our judgement. This is only preliminary (and scarce) information. To make myself clear, I do not support Cusack, rather I support fairness and justice.

Anyone who stands up for this guy Cusack is just trying to sway the opinion of others. It is so hypocritical to criticized for name calling and then...call me names! What buffoons! Further, for someone to say say I hide behind a name and then they do the same thing is even more hypocritical. I can see that some losers feel it's necessary to band together to direct anger at a system they feel has victimized them in the past. You're angry and you've lost sight of what is good and bad. Lets be realistic for the OCPD to arrest him and not give him professional courtesy--there is some validity to the charges. Hes one of them and Im sure this investigation was ongoing long enough to be sure they caught him properly. They would not want the tarnish on one of their own unless it was true.

I saw Cusack in church a month before his arrest... he was praying, lighting candles and did NOT taking communion... His wife and 17 and 20 YEAR OLD daughters were also there... NOT WITH HIM... 5 rows back.. they WOULD NOT LOOK AT HIM WHEN THEY PASSED HIM... They convicted him of something a month before his arrest...

It's pointless to argue if this 17 yr old is a child or acts as an adult.Also sad to argue his actions at church or his family's past, it's private.The facts are he was hired and trusted to be a PUBLIC supervisor and role model of 150 youth,she wasn't.He was hired to UPHOLD THE LAWS and supervise teens,your teen daughters,neighbors daughters and relatives daughters.As a retired cop,he knows the laws and consequences,he knows how to lawfully go about ending unwelcomed advances from anyone,even female teens, if the case, if he wanted to.He was hired by the school district as a supervisory/security aide to protect the youth! He failed to uphold his RESPONSIBILITIES and the LAW,apparently over a period of time,forcing his fellow police officers to arrest him and the city to fire him! Why would they choose to 'tarnish the police dept and city' in the peak season?They HAD TO! They had enough evidence! Let's keep in mind, as a retired cop,if his 16 yr old daughter was 'the victim' in this situation,he would likely be having this 49 yr OLD MAN Beach Tag Supervisor arrested,fired, and publically castrated if he could!He had a responsibility in his position and allegedly made choices that are unacceptable to both the city and the police dept.More facts will come out and need to.We should be asking where does this case stand?Last report states no attorney had come forward for Cusack and no arraignment had been set.Why?Argue for more facts and more reporting to keep the rumors in order!
