Council to Consider Revised Elevation Guidelines Tonight

City Council will vote on amendments that clarify rules for rebuilding and elevating after Superstorm Sandy.

 

City Council has a full agenda for its public meeting 7 p.m. tonight (Feb. 28) at the Ocean City Free Public Library.

But details on one proposed ordinance were released on Wednesday.

Council will consider amendments to zoning ordinances that address building heights and elevations. The ordinance is especially relevant in the aftermath of Superstorm Sandy as homeowners repair damage and consider elevating their homes.

The full text of the proposed ordinance is attached to this story as a PDF, but here is the summary of the changes provided by the city:

Summary
2013 Residential Mechanical

Section 1 –

Permits buildings with nonconforming setbacks to elevate to BFE/ZFE without variance approval

 

Section 2 –

Redefines Attic as non-habitable space

BFE is revised to include ABFE and other maps as may be adopted

Redefines Nonhabitable Building Area to include: Porches, Decks, balconies, Attic, unfinished area below BFE, Carport, Garage, Crawlspace, stairwell, elevator, Storage Room

Clarifies that residential Building Height is measured from ZFE

Removes Carport from being calculated as a Story

Redefines Floor Area Ratio to exclude Crawl Spaces

Specifies that Garage with 8’ ceiling is non-habitable space

 “V Zone” exception removed from Zoning Flood Elevation

Story term/definition will be deleted if determined that this control is no longer needed

 

Section 3 –

Permits HVAC equipment in the Riviera to be elevated to BFE

 

Section 4 –

Permits HVAC equipment in the Bayou to be elevated to BFE

 

Section 5 –

As a Design Incentive, removes 6’ height limitation and permits steps and landings within 6” of property line

 

Section 6 –

As a front yard Encroachment, removes 6’ height limitation and permits steps and landings, and terraced walkways within 6” of property line

As a permitted rear yard Encroachment, permits steps and landings to Lowest Floor without height limitation

As a permitted side yard Encroachment, permits HVAC equipment to be elevated to BFE

As a permitted corner lot side yard Encroachment, permits terraced walkways

 

Section 7 -

FAR is applied to the Habitable Building Area only

Our officials are doing a great job getting together with architects and engineers that are from our community. The steps that are being taken are being done with great thought, future planning is very important.

Wow do you have any idea what’s going on here? The Planning Board is made up of people from the development community. The architects and engineers you mention are a part of the development community. Parts of the Master Plan came straight from the development community. City government serves the development community. And so much of our money and effort seems to go into making money for who? The development community and tourism. And what did it get us? Over development and all the problems associated with it … blocks and blocks of cookie cutter duplexes that sit vacant 9 months out of the year … a loss of residents, a loss of commercial, and a dying community … declining property values, especially in areas of town that should never have been developed. Increased flooding, bad roads (I could go on.) And in our determination to make money hands over fists everything else is neglected. Beach replenishment, roads and drainage, infrastructure. The only thing we do well here is to make money for the development community (and tourism.)

I don’t recognize your business name. Are you a major player here? Did you ever notice how all the plums seem to fall to the same businesses? Can you buy commercial property at a discount and get it rezoned for residential? Does the City work for you? Can you easily obtain variances and subdivisions? Which side of the mountain are you on? The wet or the dry side?

The Planning Board is supposed to function as a check and balance to demand driven development. It was until it too was brought under the control of the development community.

There were parts of the Master Plan the Planning Board had to wait to advance pending approval of the board of realtors and the chamber of commerce.

As for the public however the Planing Board refused to take or answer questions at the public hearing..
